Seller-Terms and Conditions and How the Program Works

Evaluation

The first step in the process is to arrange a consultation to determine the potential value of your painting and the demand for your art work. This can be done by submitting the item for review to be entered into Yazzy’s auction and selling program. Complete an auction estimate request form for this action.

Due to the high volume of requests we receive, we ask that you please be patient. We will respond to your auction estimate request as soon as possible. It is very important to Yazzy's to provide the highest level of service; accordingly, we cannot rush pre-auction valuations.

Decision to sell

Based on the pre-auction valuation's results, you and Yazzy's staff will decide whether your property is appropriate for sale at auction. We will also recommend an appropriate venue and possible sale timing. If you decide to proceed, you will pay a seller’s consulting fee and sign a contract which includes Yazzy’s commission.

It is important to know that the supply of a particular Verdult painting may outweigh the demand for that artwork. In this case, we will advise you that in our opinion the timing to sell your particular item may not be right and we will not take the item into our auction system for sell.

It is also important to note that there is no guarantee that if your artwork is pre-qualified and is assigned a pre-auction price that your artwork will sell in the allocated time or that it will ever sell or sell for the pre-auction price or a price that you may deem appropriate.

Once taken into our selling and auction inventory, Yazzy's will include the art work in its next earliest auction ensuring that the artwork is published and promoted on its website auction and sell network as well as though its publicity arm on the Internet.

Seller's contract

The seller contract covers three important issues that will affect your bottom line: the reserve price, Yazzy's consulting fees and commissions and your representation concerning the artwork.

Reserve price

The reserve is the confidential minimum selling price to which a consignor (you) and Yazzy's agree before the sale - your property's "floor" price, below which no bid will be accepted. If bidding on your item fails to reach the reserve, we will not sell the piece and will advise you of your options. It is important to consider the reserve price in light of the fact that Yazzy's will assess fees and handling costs for unsold lots.

Seller's fees and commission

Sellers pay a consulting fee of $999 to $5,000 depending on the number of paintings and a commission. The consultant fee is paid at the start of the process and is non-refundable. The commission is deducted from the hammer price. The Selling commission is fifteen percent.

Representation Concerning Art

Artwork must arrive at Yazzy’s offices in the state in which it was represented, i.e. excellent, perfect or pristine condition.  If there is any damage to the artwork, at Yazzy's sole determination, the Corporation will deduct the cost of restoration from the purchase price after the Fifteen Percent (15%) placement fee has been deducted.  The same conditions will apply if the artwork has been represented as framed. At Yazzy's sole determination, Yazzy’s will deduct the cost of framing if there are any scratches, chips, dings, blemishes and/or discolorations, which could jeopardize the sale of the artwork.

 

Payment

Shortly after the sale, you will receive a listing of the final hammer price for each item you entered into our auction process. We will send payment within 14 days from the day of the sale provided we are in receipt of the buyer's payment.

Required Documents

Seller must provide all documentation for the artwork including: Certificate of Authenticity "COA", letter of provenance, invoice and/or receipt of the original purchase.  If a COA is not available, at its discretion, Yazzy’s may provide the COA at a reduced rate off of its COA schedule. 

If the art is not sold through Yazzy’s auction process but by private means, Yazzy’s will inform the Seller of all qualified offers upon your request.

Yazzy’s will promote your artwork through its auction and selling network and will allow 120 days for your artwork to sell. Provided that both parties agree, you will have an option to extend your contract for 60 days.

Yazzy’s will advance free of charge, unless otherwise stipulated, all marketing, technology and color correction/balancing required in order to successfully post the listing of your artwork.  Yazzy’s at its discretion reserves the right to withdraw any listing at any time.

Upon written (Email) and/or verbal notification of the sale of your artwork, you will be required to have the artwork delivered to Yazzy’s corporate office within five (5) days.  You will be required to cover all shipping costs to Yazzy’s. Yazzy’s is responsible for all shipping costs thereafter.

Yazzy’s receives a consulting fee of $999 to $5,000 depending on the number of paintings and a Fifteen Percent (15%) commission on all artwork sold through Yazzy’s. The consulting fee is non refundable and paid at the time the art is entered into our selling program.

PLEASE BE ADVISED YOU MAY ONLY SUBMIT ARTWORK IF: YOU ARE THE OWNER OF THE ARTWORK, IT IS FREE AND CLEAR OF ALL LEINS AND ENCUMBRANCES, IT IS NOT OWNED BY MULTIPLE INDIVIDUALS, YOU HAVE THE RIGHT TO SELL THE WORK.  Yazzy’s RESERVES ALL RIGHTS AND REMEDIES FOR MISREPRESENTATION BY THE SELLER.
